'Nose blow' driver case dropped

A businessman who claimed he was fined by police for blowing his nose while driving has had the case against him dropped.

Michael Mancini said he had been given a fixed penalty notice after using a handkerchief while his van was stationary in traffic in Ayr.

The 39-year-old refused to pay the £60 fine and the case had been expected to be heard by a court.

But prosecutors said no further action would be taken.

A spokesman for the Crown Office and Procurator Fiscal Service said: "After further enquiry and careful consideration of all the facts and circumstances of this case, the procurator fiscal has decided that no further action is required."

Mr Mancini, from Prestwick, told BBC Radio Scotland's Newsdrive programme that he was "glad common sense had prevailed".

He added: "I think the authorities need to learn a little bit of common sense and worry about more important things."

Mr Mancini described last month how he had applied his vehicle's handbrake before using the tissue to clear his nose.

But he claimed to have been "stunned" when he was waved over by a police officer, who told him he had not been in full control of the van.

The incident happened on 26 October at the High Street in Ayr, when Mr Mancini said he had been suffering from a heavy cold.

Mr Mancini's solicitor wrote to the procurator fiscal last month stating that it "beggars belief" that a ticket had been issued under the circumstances.

However, the prosecutor had insisted the case would go to court if the fine was not paid.

The police are cocks and this confirms it. Never liked them and never will.

 A bit harsh generalising all off them with the same brush, there are a few officers on this forum too. But IMO there are quite a few jobs worth and bullies on the force.

It's nice to know the nose case has been cleared.[/code]

Been on the wrong side of the law have we? Grow up!
In fairness, the guy who this is all about was clearly on the wrong side of the law, until cleared.

Regardless of whether some people have fixed opinions on police, or not - one thing you have to admit - this was truly an abuse of the office. Four police involved, and not one had the common-sense - no scratch that - the simple human decency to call stop to the whole thing.

As much as people who break the law, deserve prosecution, police who bring contempt on their profession deserve sanction, too - and this was most definitely such a case.

'Discretion' a word used by s few people on here

Doesn't exist anymore. This Labours governments obsession with stats and figures has eroded this part of British policing so that it is now almost non-existent.

There is a thing in the Police Service known as KPI - Key Performance Indicators - Basically this means that you have to do a certain number of things each month. If you fall below these set standards you can find yourself being taken down the route of UPP, unsatisfactory performance procedure, which is a potential job loser. You don't receive any 'bonus' payments for then hitting the targets.

The Police enforce the law and put in practice what the current Government wants. I agree that this Case is nonsense and should never have been allowed to proceed. But the Government want figures, the Police Chiefs want figures so when something easy comes along an Officers is really tempted by 'booking', 'arresting', 'cautioning' such people.

The policies of this government have isolated the Police from the public, caused much disaffection with frontline Officers and pisses me off. We are the tool of Governments. Maggie used us to break the miners and no doubt we will be used again.

Please don't generalise when calling all Police Officers 'names', there are good and bad in all jobs.

good post Gadro.

I hope tintin was just sounding off in general. Im sure he can't hate all individuals.

Maybe tintin is in the same position as me where he has been badly let down by the plod.
My Wife (then girlfriend) was flashed at and intimidated while waiting for me at college years ago. She was traumtised by this quite badly. The incident was reported to police with his description and details of his car (he was another student at the college) and I even tailed him to his home address and handed this to the police.
The upshot of this, absolutely nothing, however there are plenty of speed traps in our area.

I will hold nothing but contempt for the police for the rest of my life.

Carl.
