The seatpost hanging below has no load on it so will be doing nothing.
On shim length, I would certinly want it to run to at least an inch below the tube junction on the seat tube. Konas and others with long seat tube ends above the top tube really should have longer shims to make sure that there is full support through the weak welded area.
