Re:

Thanks for the replies. Some have been helpful, But the overall tone of it is that whether this guy is legit or not then I'm still going to lose my money. And before anyone else gets technical about who's money it is, the outcome is still the same so please don't bother....

A few things that are making me raise an eyebrow though;

-This guy is being overly polite like he is maybe trying to keep me sweet until the time is up on the case and he gets money returned :?

-he opened the case only 2 or 3 days after the item was due to arrive, seems like that's jumping the gun a little

-first class postage was requested to ensure it gets there asap, but no tracking was requested. This strikes me as unusual too

-he apparently went to the sorting office today and no sign of it (though this could be total bollocks)

-also a bit of a coincidence that I posted 6 cheap items at the same time using the same service to people on retrobike and they have all arrived. Only the one 'more expensive item' hasn't. This Strikes me as a bit suspect

So if it was any of you guys, what would you make of that?

About the only part of what you've listed above that seems even mildly "odd" is that he's been quite quick to assume it's missing in the post. But what's wrong about any of the other stuff?? Seems all fairly legit to me.

If it was me I would be kicking myself for not insuring something adequately enough. Yeah, things get lost in the post and yeah people will occasionally try it on.....which is why you should cover yourself, especially on something of that sort of value.

BTW - unless it's changed recently Royal Mail don't class packages as being lost for a period of 15 working days after it was due to be delivered. Worth having a look through the T&C's if you haven't already.

If I may... it does seem a little odd about opening the case smart-ish - but is that elapsed time from when it should have arrived given when you posted it, and the class of postage? Or the tolerances in the delivery estimates that are a bit generic on auction pages?

What's the elapsed time from posting, to when he opened a case?

All the same, I fear that musing this and over-thinking it, isn't going to be a good thing for your peace of mind. If he's honest, and it doesn't arrive, you're stuffed; if he's dishonest you're stuffed - you should be able to claim something back from Royal Mail, but may only be about 20 quid.

The only possible good scenario, is some delay in delivery AND he's honest - we can all theorise how likely / unlikely that is, given what we know so far, but really - it won't make you feel warm at night.

We can all pontificate and infer he either sounds dodgy, or may simply be a victim like you - but will it make you feel any better?

You have my sympathy - in it can be something of a sting, at a time when it's of most need - but all the same, whatever is said in discussion, isn't going to change how you may well end up out of pocket. I just can't help but feel that it's like the five stages of grief - you're lingering at 2 - do yourself a favour, fast-forward to 5.

I was caught out a few years ago sending a car stereo out with proof of postage but nowt else. The thoroughly nice chap jumped up and down claiming I hadnt posted it etc etc withing days of posting.

Despite having a proof of postage receipt, at that time, ebay and paypal were having non of it so lost the radio and the money.

Everything of reasonable value is signed for, bikes are tracked.

Re:

It was due on Monday. The case was opened Thursday morning (yesterday) so barely 3 days this guy has waited. And said he's sent me numerous messages when I've only received 1

Things do go missing :( I have signed 97 letters today (big brother knows what I do) and a pound to a penny some will go astray and I'll have to get them resent.

He requested the item ASAP so I guess he was expecting next day delivery........how much did he pay for delivery?

Re:

As for opening a case, I recently had three open and eBay to open it as a case.
If you follow contact seller, item not arrived yet. It then has to be after the time eBay estimates, which I assume is based on what you enter in the auction.
It automatically opens the case, you don't seem to be able to easily just use messages. Which I use to do.
So don't think opening a case is anything harsh, it's just the way eBay does it now.

Delivery is always your responsibility, you choose how you want it delivered.

Edit/ missed a page/ Proof of postage just means you'll need to claim with the post office if it cannot be proven it was delivered.

It a bugger isn't it, but its only the iPod you're actually loosing.

Just worth reiterating this, the delivery, and everything about it is the sellers choice, and the sellers responsibility. What the buyer tells you is irrelevant, if a buyer deliberately asks for untracked, or second class, ignore them. It's not their call. It's yours.

If it has gone missing (which I doubt) then the blame for this does not lie with me, more the company I paid for a service I have not received ie. royal mail

Buyers treat people trying to raise cash as if they're dealing with a large company, I don't have any contracts or policies, i sell something and drop it off at the post office, It's really that black and white. I've done nothing wrong to lose this packet, I sold it, I posted it and if it goes missing then a refund should be to my disgretion or from the company that so say lost it in the first place.

I'm sorry to be blunt, but you are to blame for being out of pocket. You sent a £150 iphone through the post, uninsured and untracked? You're a fool!
