check you old mag 20's!

When I was i Shimano QC we had a 15-year old chainset came in that had snapped - turned out it was affected by a recall and they covered it, no questions asked. IIRC I think the punter was even compensated for damaged clothing.

Recalled items are covered by a different set of rules than normal warranty.

Also You can check the brace! I saw few cracked near outer mounting bolt....

I'd guess there's a statute of limitations on recalls. All so guessing the new Rock Shox owner (SRAM) is probably not held liable in this case since they had nothing to do with the original design.
 
Looking at the granularity of the casting in the broken crown I'd say it's been heated at some point in its history and the steerer changed... :?:

Is AFAIK the clincher in this situation, unless the takeover expressly included transfer of liability.

Product liablilty is tricky... It's regulated by the EU and gives huge flexibility to the end user who can basically sue anyone they want (who can then countersue further up) in the supply chain if it is to their advantage and not unreasonable. This is to prevent Joe Bloggs from having to spend a fortune suing a manufacturing facility in Taiwan etc etc... and also ensures that they have somewhere to go if one of the links in the supply chain no longer exists.

I've dealt with a few product liability cases in my time (not just Shimano) and manufacturers always just pay up from their insurance. Saves them a lot of money compared to getting the lawyers in.
 
I have a pair of Mag 30s and when I discovered that recall I contacted the importer a couple of years ago. They no longer have any of the replacement crowns that were intended to replace the dodgy ones. I also contacted an university friend who now works for Rockshox in California (lucky bastard) and they don't have any crowns either. They were not unduly bothered by a 15 year old recall, I guess the design life of bike parts is rather less than that.

The granularity seen in those photos is present in my forks and the corroded material has less strength than chocolate. The crown on my forks was fine until I rode in the snow a few years back so I'm not sure heat is the issue, I suspect salt.

My problem has recently been solved by buying a pair of Pace RC35s of ebay and talking nicely to Justbackdated.
 
slightly different note, my mate got his tv repaired even tho it was out of warranty, arguing sales of goods act,
